Please read this in full. It is written in plain English but it is a legal agreement.
In this agreement, "the Producer" means The Echo Project (based in Ayrshire, Scotland). "Contribution" means my interview, appearance, image, likeness, voice, performance, name, and any material I provide or that is recorded of me. "the Films" means the documentary films, series and related content produced by The Echo Project.
- I agree to take part in the Films and I grant the Producer the right to record, film, photograph and reproduce my Contribution.
- I grant the Producer an irrevocable, perpetual, worldwide, royalty-free licence (subject to clause 4) to edit, copy, adapt, distribute, exhibit, broadcast, stream, license and otherwise exploit my Contribution as part of the Films, in all media now known or later devised, including YouTube and other online platforms, film festivals, cinema, television broadcast, and educational or non-broadcast screenings, and in trailers, clips and promotional material.
- I understand the Producer has full editorial control and final cut, and that I do not have the right to approve, alter or veto the finished Films.
- My right to withdraw. I may withdraw my consent by writing to the Producer at bryan@theechoproject.co.uk within 14 days of the date I sign below. This 14-day window is the editing stage before publishing. After those 14 days my consent becomes irrevocable, and I may not withdraw it or require my Contribution to be removed once a festival submission, screening, publication or broadcast run has begun or been committed to.
- I confirm my Contribution is truthful to the best of my knowledge, and that it does not knowingly infringe anyone else's rights.
- No fee is payable for taking part unless separately agreed in writing.
- I waive any moral rights I may have in the Films to the extent permitted by law, so the Producer can edit and use the material as described above.
- Your personal data. The Producer will hold my contact details securely and use them only in connection with the Films, in line with UK data protection law. My statutory data protection rights are unaffected by this agreement and are explained in the Producer's Privacy Policy at theechoproject.co.uk.
- My own use of footage. If this documentary is about me (I am the main contributor), I understand the Producer may also give me copies of clips featuring me, for my own separate use, including commercial, social media, and publishing use, provided that such clips do not also feature another identifiable contributor whose separate agreement is required under clause 10 below.
- Sharing clips with the main contributor. If I am taking part as an additional contributor to another person's story (as named by me above), I have indicated above whether I agree that the Producer may give copies of clips featuring me to that main contributor, for their own separate use, including commercial, social media, and publishing use. If I have chosen not to allow this, my Contribution will be used only within the Films produced by the Producer, and will not be shared with the main contributor for their own separate use. The Producer has no control over, and no responsibility for, the main contributor's use of any clips shared under this clause.
- This agreement is governed by the law of Scotland and is subject to the jurisdiction of the Scottish courts.
